The security and privacy of your personal data are important to Vitropor, therefore we develop our commercial activities in strict compliance with the applicable legislation on personal data protection.

We undertake to explain, whenever necessary, how Vitropor will use your data in order to guarantee that you find the house, office or store you are looking for on our Platform. It is also our commitment that all information collected will be stored securely, both in Vitropor and by other partner entities with whom we work.

This Privacy Policy seeks to explain what personal data we collect about our users, how and why we use it, with whom we share it, and how we protect your privacy.

1- Who is responsible for your data?

Our Privacy Policy applies exclusively to the personal data that Vitropor collects from the Vitropor.pt website. References in this Privacy Policy to “we”, “us” or “our” mean Vitropor.

For the purposes of data protection law, we are the “Controller” for personal information provided through this website (“Website”).

This Privacy Policy determines what happens to personal data you may provide to us through the Website.

This Privacy Policy may be changed and updated at any time, with new versions posted on the Website.

2- What data do we collect about our users?

Whenever “personal data” is mentioned in this Privacy Policy, it must be assumed that it refers to information related to our users and that allows us to unequivocally identify them, either directly or in combination with other information that Vitropor may hold. Your personal information may include, for example, your name, your contact information, information about your expectations for a particular product you have contacted, or information about how you use our Web site, or interact with us. Vitropor collects personal data from users, for example, when they contact us using the forms provided on the Platform, explore our Website (even if they only search for Apartments, Houses or Offices), or contact us by telephone. We may also receive personal data from our users through our partners who provide services to them on our behalf.

The use of the Platform may be monitored in order to analyze and interpret, in an aggregate and anonymous way, the patterns of use of the Website, thus allowing us to improve the levels of service and the satisfaction of our users’ expectations.

3- Purposes of the personal data collected:

Based on the information entered by users in Vitropor’s Platform, the Data Controller will process the data in order to achieve the following objectives:

Enabling users who access Vitropor’s website to be contacted by Vitropor associates, following the completion of the existing form on the products page, contacts page or others;
Answer the users who have contacted Vitropor, from its Platform, so that we can clear up any doubts that may have been raised

With regard to the information automatically collected by the Website, based on the browsing that our users have done, its processing will be promoted, in order to pursue the following purposes:

Create anonymous, aggregated information about the characteristics and behavior of Website users, including for targeting and developing anonymous profiles (personas);
Improve the Platform’s performance;
Promote a more personalized experience, so that the search you perform returns the results you really want;

They also have the right to be informed before personal data are disclosed for the first time to third parties for direct marketing purposes or used on behalf of third parties, and to be expressly offered the right to object, free of charge, to such disclosures or uses.

Users may also contact us to oppose the processing of their personal data, request that it be erased, or that there be a limitation on its processing, as well as request the right to portability of personal data under the terms and within the limits established by law. They also have the right to request that third parties be notified of the rectification, erasure or limitation of the processing of their personal data.

In addition, users may also lodge a complaint with a supervisory authority, which, in Portugal, is the National Commission for Data Protection.

We would also like to remind you that part of the information entered in the Platform may not be under Vitropor’s direct management, so in these cases we will make every effort to ensure that the requests made by users from the Platform are respected.

5- Information security and quality:

Our objective is to guarantee the quality and integrity of the information provided by users who use Vitropor’s website. Therefore, the necessary technological and organizational measures have been implemented in order to keep the information safe, precise, updated and complete.

To ensure maximum security, in the areas of the Website where the users’ personal data is collected, its transmission is encrypted.

6- With whom do we share your data?

The personal data of our users will not be transferred to third parties, except:

If Vitropor has your express authorization;
To entities directly or indirectly related to the targeted business or potential business;
If required by law;
If it is strictly necessary to ensure compliance with our terms of use, rights or ownership.

Vitropor employees and its associates may have access to their personal data for the purpose of managing the Platform. However, they are under a confidentiality obligation regarding the data to which they have access within the scope of the operations of the respective IT base.

Vitropor’s employees and associates are duly informed of the importance of complying with this legal duty of secrecy, and are responsible for fulfilling this confidentiality obligation.

The Site uses Google Analytics for Display services, including the remarketing function. This function consists of displaying ads to users who have already visited the Platform.

You may opt out of Google Analytics for Display Advertisers and not be exposed to ads from the Google Display Network. To do this, you can access the Ads Preferences Manager and the Analytics Opt-out Browser Add-on.

Vitropor may promote remarketing practices to advertise online, which means that users who do not opt-out of the Google Display Network through the aforementioned methods may be exposed to advertisements from Vitropor in Google’s content network. Third-party entities, such as Google or Facebook, can display Vitropor ads on the sites of their content networks. Third parties, such as Google or Facebook, may also use Cookies (such as Google Analytics and DoubleClick Cookies) that serve to optimize ads based on information from users’ past visits to the Website.

7- Where is personal data stored and for how long?

The data that Vitropor collects from its Platform will be stored in servers located within the European Union.

The length of time for which data is stored varies depending on the purpose for which the information is processed.

There are legal requirements that data must be retained for a minimum period of time. Thus, and whenever there is no specific legal requirement, the data will only be stored for the minimum period necessary for the purposes that motivated their collection or their subsequent processing, or for the period of time authorized by the National Commission for Data Protection, after which Vitropor will endeavor to delete the respective personal data from all the databases in which they appear.

8- Technical and organizational measures and treatment safety:

All the information that Vitropor receives from the users of its Platform will be stored in safe servers and, in conjunction with our technological partners, we will promote the implementation of technical and organizational measures necessary for any personal data to be protected at an adequate security level that guarantees, in particular, the confidentiality and integrity of the data and that prevents the destruction, loss, accidental or unlawful alterations or, further, the unauthorized disclosure of or access to the same.

Notwithstanding the measures implemented to protect your data, each and every user should be aware that the transmission of information over the Internet, or other open networks, is never completely secure, and there is a risk that data can be viewed and used by unauthorized third parties. Vitropor is obliged to warn all those who surf the Internet that they must adopt additional security measures, namely, ensure that they use an updated device and browser in terms of properly configured security patches, with an active firewall, antivirus and antispyware, and ensure the authenticity of the sites they visit on the Internet, and avoid websites whose reputation they do not trust.

The Website may contain links to other websites, or to other applications, including those of our partners. If you access one of these links, please note that each one has its own privacy policy and Vitropor cannot be held responsible for these policies. It is advisable to read the privacy policies of other websites before submitting personal data through them.

General Terms and Conditions of Sale

1- Acceptance of Terms

he customer agrees to the terms and conditions of sale set forth below and assumes full responsibility for familiarizing themselves with them. The customer has an average of three days from the date of receipt of the merchandise to notify Vitropor Lda. in writing of any defects in the product received.

 

2- Force Majeure

The delivery date is always given for guidance only, and Vitropor Lda. shall not be held liable for any delays, unless otherwise agreed in writing. Vitropor Lda. shall not be held liable for delays resulting from force majeure.

 

3- Transport

Goods transported in the Customer’s vehicles are carried at their own risk. Where the transport of invoiced products is carried out by a Vitropor Lda. vehicle, and at the Customer’s own risk, claims for damage caused by any breakages or damage arising from transport will only be accepted if reported in writing to Vitropor Lda. within a maximum of 24 hours from the time of unloading. The pallets supplied for the transport of the goods are the property of Vitropor Lda. The delivery of a damaged pallet or failure to return it within a maximum of 15 days from the date of delivery of the goods will result in a charge of €500 (five hundred euros) per pallet.

 

4- Tolerances

All materials are produced in accordance with Vitropor Lda.’s internal procedures, subject to the tolerances specified in the standards applied by the competent authorities to the production and processing of glass.

 

5- Warranty Against Defects

The Vitrotermo seal is covered by a 10-year guarantee. This guarantee shall be void if the guidelines for storage, handling and on-site application are not followed. The Customer is responsible for obtaining full information about the product. Claims arising from the improper storage, handling, cleaning, maintenance, use or application of the products and goods will not be accepted. A complaint, even if deemed valid, does not entitle the Customer to reimbursement of expenses relating to the assembly and dismantling of the items to be replaced. Complaints regarding any product in the order will only be considered if submitted in writing within a maximum of 5 days from the date of the supporting document/dispatch note.

 

6- Billing

The areas to be invoiced are calculated by multiplying the dimensions of a geometric shape with four right angles into which the piece fits, with all fractions of a millimetre rounded up to the nearest centimetre. In the case of other geometric shapes, Vitropor Lda.’s sales department must be consulted in advance, on a case-by-case basis, to ascertain the corresponding increase in the selling price. The products and services supplied by Vitropor Lda. are subject to minimum invoicing and supply values.

 

7- Payments

Payments may be made by cheque, bank transfer or confirming. Payment is due immediately, unless otherwise agreed in writing. All invoices, once past their due date, will be subject to interest calculated at the statutory rate in force for commercial transactions. Complaints regarding the content of invoices will only be considered if submitted in writing within a maximum of 5 days from the invoice date.

 

8- Reservation of Title

The goods remain the property of Vitropor Lda. until they have been paid for in full. The Customer must ensure that the goods remain in good condition so that, should Vitropor Lda. reclaim them, they do not show any damage or defects, for which the Customer will always be held liable.

 

9- Judicial Forum

In the event of any dispute arising from the interpretation of or breach of the contracts governing the supplies described in this invoice, any legal proceedings must be brought in the District Court of Valongo.
